These Terms of Service ("Terms") govern your access to and use of AcervoVista, a document intelligence platform operated by AcervoVista, Inc. ("AcervoVista," "we," "us," or "our"). By accessing or using AcervoVista, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the platform.
AcervoVista provides tools to help individuals and families organize documents, reconstruct timelines, identify gaps in estate records, and understand the contents of an estate. AcervoVista is NOT a law firm and does NOT provide legal advice, legal representation, or legal strategy. See Section 4 (No Legal Advice) for the full scope of this limitation.

To use AcervoVista beyond the free intake assessment, you must create an account and pay the applicable per-case fee. You agree to provide accurate and complete information when creating your account and to keep that information current.
Each case on AcervoVista belongs to the user who created it (the "case owner"). The case owner controls who can view or contribute to the case through the family collaboration feature. Case ownership is not transferable except with AcervoVista's written consent.
Professional accounts require credential verification — bar number, jurisdiction, and firm affiliation. By applying for a professional account, you represent and warrant that the credentials you provide are accurate and current, and that you are in good standing with the applicable licensing authority. AcervoVista reserves the right to verify credentials and to downgrade or terminate professional accounts where credentials cannot be confirmed.
Each case on AcervoVista is independent. No data, document, inference, or output from one case is shared with, visible to, or used to inform any other case — even if both cases concern the same decedent or the same estate. This independence is a foundational architectural principle of AcervoVista and reflects our commitment to serving each user's independent picture of their situation.
AcervoVista does not take sides between users who are parties to the same estate. If two heirs of the same estate both use AcervoVista, each user's case file is built solely from what that user provides, and is not shared with or visible to any other user.
AcervoVista's consumer tier describes what documents show and when events happened. It does not characterize any event, transfer, disposition, or action as suspicious, fraudulent, improper, unlawful, or a cause for legal concern. Those characterizations require legal judgment and are the province of a licensed attorney, not this platform.
AcervoVista includes an AI-powered assistant powered by Anthropic's Claude API. The assistant is designed to answer questions about documents, explain what process steps mean generally, and help users understand their case file. The assistant is explicitly programmed not to provide legal conclusions, legal strategy, or characterizations of conduct.
The AI assistant is limited to 50 turns per case (the "Turn Cap"). This limit exists to manage costs and to encourage users to seek legal advice for complex questions. The Turn Cap may be increased by contacting support.
Responses from the AI assistant are generated by artificial intelligence and may contain errors, omissions, or inaccuracies. Do not rely on assistant responses as a substitute for legal advice.
The Lawyer Handoff Package is a structured PDF export of your case file organized for a lawyer's first-day review. It is a document organization tool, not a legal brief or legal opinion. It does not constitute legal advice. The package carries a disclaimer on every page to this effect.
The gap map identifies documents typically required for estate administration in a given jurisdiction and case type. It does not constitute legal advice about what documents are required in your specific case. Document classification is performed by OCR and AI analysis. Classifications may be inaccurate. You are responsible for reviewing and correcting document classifications where they are wrong.
AcervoVista's consumer tier is charged per case. A "case" is defined as a completed intake. The professional tier may be purchased either per case or as a monthly subscription, at the user's election. The applicable fee is displayed at the time of case creation or subscription signup. Fees are charged in US dollars.

Early Access pricing is available for the first 500 cases opened on the platform. "Opened" means intake completed. Early Access pricing closes when the 500-case cohort is filled. Case 501 pays the standard rate. Early Access pricing is not available retroactively and is not transferable.
Because AcervoVista delivers a digital product that is immediately accessible upon payment, fees are generally non-refundable once a case is opened and the intake is completed. If you believe a charge was made in error, contact us at support@acervovista.com within 14 days of the charge and we will review the matter on a case-by-case basis.
For the professional monthly subscription, the same non-refundable principle applies on a per-billing-period basis. You may cancel the subscription at any time from your account settings; cancellation takes effect at the end of the current billing period, and no partial-month refund is issued for the period in which you cancel.
Payments are processed by Stripe, Inc. By providing payment information, you agree to Stripe's terms of service (available at stripe.com/legal). AcervoVista does not store your full payment card information. Stripe handles all payment card data in accordance with PCI-DSS standards.
You retain ownership of all documents, data, and information you upload to AcervoVista ("Your Content"). By uploading content, you grant AcervoVista a limited, non-exclusive, non-transferable license to store, process, and analyze Your Content for the sole purpose of providing the services described in these Terms. We do not claim ownership of Your Content and do not use it for any purpose beyond providing the platform to you.
We do not use Your Content to train AI models. Your case data is used only to provide the platform services to you.
You represent and warrant that:
AcervoVista's outputs are only as accurate as the information you provide. AcervoVista is not responsible for outputs that are inaccurate because the input information was inaccurate or incomplete.
AcervoVista allows case owners to invite collaborators to view or contribute to a case. By inviting a collaborator, you acknowledge that:
The AI assistant respects collaboration permissions. A view-only collaborator may only ask the assistant about information within their permitted view.
AcervoVista may refer you to licensed attorneys in your jurisdiction. These referrals are provided as a convenience and do not constitute an endorsement or guarantee of any referred attorney's qualifications, competence, or fitness for your matter.
The decision to engage any attorney is yours alone. AcervoVista is not a party to any attorney-client relationship that may be formed between you and a referred attorney. AcervoVista receives compensation from attorneys who are listed in the referral network.
You may not use AcervoVista to:
ACERVOVISTA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
ACERVOVISTA DOES NOT WARRANT THAT: the platform will be uninterrupted, error-free, or secure; document classification or gap map outputs will be accurate or complete; the AI assistant's responses will be accurate, complete, or appropriate for your specific situation; the Lawyer Handoff Package will satisfy any legal requirement; or referred attorneys will be suitable for your matter.
YOUR USE OF ACERVOVISTA IS AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACERVOVISTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF ACERVOVISTA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
ACERVOVISTA'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE FEES YOU PAID TO ACERVOVISTA IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless AcervoVista and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: your use of AcervoVista; your violation of these Terms; your violation of any applicable law; Your Content; or any misrepresentation of credentials in a professional account application.
AcervoVista may suspend or terminate your account at any time, with or without notice, if you violate these Terms or if we determine that your use of the platform poses a risk to other users, to us, or to third parties.
You may delete your account at any time by contacting us at support@acervovista.com. Upon deletion, your case files and uploaded documents will be deleted within 30 days of account deletion, subject to any legal retention obligations. Backup copies are purged within 90 days.
Sections 4, 10, 11, and 12 survive termination of these Terms.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. AcervoVista's principal place of business is in Miami, Florida.
Any dispute arising out of or relating to these Terms or the platform shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction in Miami-Dade County, Florida.
YOU AGREE TO RESOLVE DISPUTES WITH ACERVOVISTA ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Your use of AcervoVista is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using AcervoVista, you consent to the data practices described in the Privacy Policy.
AcervoVista reserves the right to modify these Terms at any time. We will provide notice of material changes by email or by posting a notice on the platform at least 14 days before the change takes effect. Your continued use of the platform after the effective date of any changes constitutes your acceptance of the revised Terms.
We will not apply changes retroactively to cases that were opened and paid for under a prior version of these Terms.
